On May 2, 2013 the Town of Ulster Town Board adopted, subject to a permissive referendum, a resolution authorizing conveyance of surplus Town property to Beth Murphy.

PUBLIC NOTICE

TOWN OF ULSTER

 

          NOTICE IS HEREBY GIVEN that the Town Board of the Town of Ulster, at a regular meeting held on May 2, 2013, duly adopted, subject to a permissive referendum, a Resolution, as follows:

 

Resolution Authorizing Conveyance of Surplus Town Property to Beth Murphy

 

WHEREAS, on or about September 30, 1960, the State of New York, Department of Public Works, abandoned a certain segment of a former state highway, also known as Old Route 213, to the Town of Ulster; and

 

            WHEREAS, the Town of Ulster has never maintained this now abandoned state highway, and this former state highway is surplus property; and

 

            WHEREAS, one Beth Murphy has approached the Town of Ulster and requested to be deeded the Town of Ulster's interest in said abandoned highway so that she may use it in conjunction with her to-be-acquired use of SBL 56.71-2-7 - the adjoining tax parcel; now therefore be it

 

            RESOLVED, that the Town Board of the Town of Ulster authorizes the conveyance of the portion of the former state highway as described in Schedule "A" to Beth Murphy, as further shown on a survey map prepared by John J. Post, Jr., Licensed Land Surveyor, dated January 2, 2013 and revised on April 24, 2013, and authorizes the Supervisor of the Town of Ulster to executed a Quitclaim Deed and conveyance documents in a form satisfactory to the Town Attorney for these portions of the former state highway, and be it

           

            FURTHER RESOLVED that such conveyance is subject to the following:

           

1.     Easements, covenants, and restrictions, if any;

2.     Zoning Law of the Town of Ulster;

3.     Such statement of facts that an accurate survey or personal inspection may reveal, and be it

 

FURTHER RESOLVED, that this resolution is subject to permissive referendum and the Town Clerk is directed to post this resolution.

DESCRIPTION OF LANDS TO BE CONVEYED TO BETH MURPHY SITUATED, CANAL STREET, HAMLET OF EDDYVILLE, TOWN OF ULSTER, ULSTER COUNTY,

NEW YORK.

All that plot, piece or parcel, situate, lying and being in the Hamlet of Eddyville, Town of Ulster, County of Ulster and the State ofNew York, being a portion of Old S.H. 116 abandoned to the Town of Ulster ,bounded and described as follows:

Beginning at a point on the Northerly bounds of Canal Street, said point being the Southerly comer of the herein described parcel;

1) Thence from said point of beginning along the Easterly line of lands of now or formerly Murphy, North 22 degrees 12 minutes 58 seconds West, 123.04 feet to a point;

2) Thence, North 49 degrees 18 minutes 45 seconds East, 52.72 feet to a point on the bounds of the newS. H. 116;

3) Thence along said bounds of said newS. H. 116, South 22 degrees 12 seconds 58 seconds East, 120.08 feet to a point on the Northerly bounds of Canal Street;

4) Thence along said Northerly bounds of Canal Street, South 46 degrees 18 minutes 49 seconds West, 53.73 feet to the point and place of beginning.

All bearings in reference to Magnetic North. Containing 0.140 Acre, more or less.

Subject to easements on record.
